STATEMENT OF UNDERSECRETARY OF ENFORCEMENT JIMMY GURULE
Thank you all for coming today. I am joined here to day by Brad Buckles, Director of ATF; Chuck Winwood, Acting Commissioner of Customs; Mark Matthews, Director of IRS CI; and Larry Cockell, Deputy Director of the Secret Service. I thought this would be a good opportunity to give the American people an update on the role being played by the Treasury law enforcement bureaus with respect to Tuesday's terrible tragedy. As many of you know, in addition to Treasury's involvement in the financial world, we also oversee 25 percent of all federal law enforcement officers operating through four primary law enforcement bureaus: ATF the Bureau of Alcohol, Tobacco and Firearms; the U.S. Customs Service; the Criminal Investigations Unit of the IRS; and the U.S. Secret Service. Treasury has always been proud of our law enforcement bureaus and the excellent job that they do in each of their respective fields. I am pleased to report that they have continued to perform at the highest levels of competence and professionalism in light of the horrific circumstances of the past few days. I know that Tuesday's attack has had a personal impact on Americans all over the globe and that is certainly true here at the Treasury Department. ATF, Customs, IRS CI and the Secret Service all had facilities at the World Trade Towers that were completely destroyed by Tuesday's terrorist actions. Our facilities are secondary however to the safety of Treasury personnel. The Treasury Department law enforcement bureaus had approximately 1,200 people housed in the World Trade Center complex. We are comforted by the fact that we have been able to safely account for most of these 1,200 people although we are still diligently searching for a few remaining members of our team.

Treasury Department Proposes Due Diligence Rules for Correspondent and Private Banking Accounts

Regulations that would require U.S. institutions to take steps to ensure that correspondent accounts with foreign banks are not used for money laundering have been proposed by the Treasury Dept. In seeking to address concerns that foreign banks are depositing illicit funds in U.S. banks, the Treasury Dept. hopes to make it harder for traditional money laundering schemes to operate. Some banks in foreign countries have virtually no operations of their own, but instead distribute funds to the accounts of other, legitimate banks. According to the Treasury Dept., this proposal would not require banks to implement or develop any new programs. Rather, it would be an addition to the current Bank Secrecy Act money laundering requirements. The proposal is made to fill in gaps in current reporting and, in general, will require nothing new when U.S. banks accept correspondent accounts from foreign-owned, U.S.-chartered banks. As such, U.S. institutions would not need to make changes to how they deal with a nationally chartered bank, even if a controlling share of that bank’s stock is foreign owned. D UE D ILIGENCE P ROGRAMS
Under the proposal, which would implement Title III of the USA PATRIOT Act of 2001, certain U.S. financial institutions—including banks and non-banks such as securities broker-dealers, futures commission merchants and introducing brokers—would be required to establish a due diligence program for correspondent accounts they maintain for specified foreign financial institutions. These programs would be designed to detect and report money laundering and to conduct enhanced due diligence for accounts maintained for foreign banks from certain jurisdictions considered to be of higher risk for money laundering.

Trade Community Survey to Help Report to Congress
The Treasury Advisory Committee on Customs Commercial Operations (COAC), in partnership with the U.S. Treasury Dept., has developed a survey the trade community should submit by May 18 to ensure the department has accurate information for a critical report to Congress. The report will identify for House and Senate committees the regulatory and procedural changes that should be made to reduce the reporting and record retention burden on commercial importers. Congress ordered the report because of concerns that the collection of import data may be overly time consuming and unnecessarily costly. The nine-page survey has two parts. Part One involves answering 12 questions about the costs of import operations and compliance. Part Two seeks input on six areas of customs entry data and record retention rules. Respondents do not have to submit information that identifies them. Importers can submit completed surveys by Email, fax, or regular mail to COAC’s central collection point.

The United States Coast Guard was officially established in the Department of the Treasury in 1915. It was formed by consolidating the Department of the Treasury's Revenue Cutter and Lifesaving Services. One of its many functions was to maintain casualty and wreck reports on U.S. vessels that sustained or caused accidents involving loss of life, serious bodily injury, or loss of property. This collection is an index to those casualty reports for the years 1913 through 1938. The collection consists of microfilmed copies of index cards of ship casualty reports. The cards give the name and home port of the vessel, type of accident (collision, stranded, foundered, loss of life, or other), date of the accident, location, the nature and cause of the accident, the number of lives lost and the names of the dead, the value of the vessel and its cargo, the monetary damage sustained to the vessel and its cargo, and the number of passengers and crew aboard. The cards are arranged chronologically by fiscal year and alphabetically by ship name within each year. The collection was acquired from NARS in 1985.

The use of special agents in the Treasury Department was first authorized by an Act of Congress approved August 6, 1846. Their duties initially were to examine books and accounts of public money depositories. Later these duties were expanded to include the examination of books and accounts of collectors of customs and other customs officers, the investigation of the administration of revenue laws and regulations, and the detection and prevention of frauds or attempted frauds against the revenue. Supervision of special agents was through the Special Agents Division, which had been established in the 1860's in the Office of the Secretary of the Treasury. The functions and records of the Division were transferred to the Bureau of Customs when it was established in 1927. The collection contains the files of the Department of the Treasury's Special Agents Division for Alaska. Included are a published copy of the Alaska purchase treaty; a copy of the protocol of transfer with inventories of property included in the transfer; copies of laws and regulations relating to the administration of Alaska; copies of correspondence between the Secretary of the Treasury and the Secretary of State enclosing letters from American and foreign diplomatic officials; correspondence with other U.S. government officials concerning activities in Alaska; letters and reports from customs officials and Special Agents in Alaska concerning the administration of customs laws, smuggling, and other illegal activities in Alaska; and letters from various commercial companies in Alaska. There are also maps, newspaper clippings, and other publications relating to activities in Alaska.

Short-Term Ex-Im Bank Insurance Support Exports of consumer goods, spare parts, raw materials (on terms up to 180 days) and bulk agricultural commodities and quasi-capital goods (on terms up to 360 days) can be supported under Ex-Im Bank’s short-term insurance policies. Ex-Im Bank will consider all short-term repayment terms in the PRC. To date, Ex-Im Bank has approved the following Chinese banks for short-term insurance coverage: Bank of China, Citic Industrial Bank, Agricultural Bank of China (head office), Hua Xia Bank, China Construction Bank, Fujian Industrial Bank, Bank of Communications, Industrial and Commercial Bank of China, China Everbright Bank, China Merchants Bank, Shanghai Pudong Development Bank, and Bank of East Asia. Ex-Im Bank will consider other banks that meet its short-term credit standards.
