State of Rhode Island - Division of Taxation Personal Income Tax Regulation PIT 90-02 Family Education Accounts - Qualified Depositories I. GENERAL In accordance with section 44-30-25 of the Rhode Island General Laws, any qualified depository may accept deposits as family education accounts. II. DEFINITIONS A. Family education account means an account created by an individual taxpayer for the purpose of providing qualified educational benefits to a qualified beneficiary. The account must be with a qualified depository and must be created by a written instrument prescribed by the Tax Administrator that clearly designates that the account is a family education account. The assets of the account cannot be commingled with other property except in a common trust fund or common investment fund of that qualified depository. 1. Account Type, Amount and Source of Funds A family education account is set up by an individual taxpayer; and therefore, family education accounts cannot be set up as joint accounts. While the tax benefit (modification) may be used on a jointly filed Rhode Island personal income tax return, only one individual is considered to be the "taxpayer" depositor who sets up the account. Providing that the above qualifications are met, a family education account may be of any type commonly offered depositors of the qualified depository and may bear any terms or conditions, maturities or deposit insurance commonly associated with other deposits or savings plans in accordance with the laws of the State of Rhode Island. For example, a family education account may be a passbook savings account, a credit union account, a certificate of deposit, a term savings account, etc. The family educational account has no required maximum amount or required term of existence except that the account balance is deemed distributed in accordance with section 44-30-25(a)(3). The account may be established with funds from other types of savings or trust vehicles either of the taxpayer or of a qualified beneficiary.

Rhode Island: Child Day Care Center Regulations for Licensure (1993) THE LICENSING PROCESS The primary purpose of licensing a child day care center is to safeguard the well-being of the children served. Granting a license means there is clear evidence that the building and grounds are safe; that staff are appropriately trained and responsible; and that the program shall, in practice, reflect an understanding of the healthy growth and development of children. Further, the license is meant to be an assurance to parents and the community that the children are being cared for in a safe, healthy environment where appropriate activities, time schedules, food, materials, equipment and staff are consistently available and are used for encouraging and supporting the children's physical, social, emotional, and intellectual growth. Licensing is a method of regulation designed to implement the state's obligation to the families whose children attend day care centers. A license is granted after a detailed evaluation of the facility and program has shown that conformity to the established regulations prevails. The regulations used for this evaluation are described in SECTION II of this publication. An application for licensure may be obtained from the Day Care Licensing Office of the Rhode Island Department of Children, Youth and Families. A: PROCEDURE FOR OBTAINING A LICENSE 1. CONSULTATION - Any person, firm, corporation, association or agency interested in opening a day care center program for school age children shall contact the Day Care Licensing Supervisor for assignment to a licensing worker. The following article appeared in Volume 21, No. 2 of Future Reflections , the quarterly publication of the organization. Here it is: Cutting or gutting services is the question uppermost in the minds of over 150 families of blind and visually impaired children in Rhode Island. So far no one is coming forward with any answers. Many states across our nation (Rhode Island among them) are struggling with revenue shortfalls and other budget problems. A weakened economy has compelled several state governors to order across-the-board cuts in state government spending. In such circumstances it isn't uncommon for services to blind children to take a proportional hit. In some states this means budget cuts to the state-funded schools for the blind. In a few states (such as New Jersey) children's services provided by state-funded commissions for the blind suffer cutbacks as well. Never a completely independent department with its own budget and dedicated administration, the VSP program office is currently located on the campus of the Rhode Island School for the Deaf, and, as of September of 2001, it is administered by the superintendent of the Rhode Island School for the Deaf. Despite these limitations there has been much to commend the Rhode Island Vision Services Program since its inception.

None of this is pleasant, but neither is it unexpected, nor, providing that the programs had reasonable funding in the first place, is it grossly unfair. This is not to say that parents and blind advocates should take such cuts meekly—only that cycles of fat times and lean times are normal, and all must work together to minimize the impact of the lean times. But making cuts in a program is one thing; gutting it is another. A trimmed rose bush can grow back; a gutted fish is a goner.
