THE OHIO ETHICS LAW: CHAPTER 102. OF THE REVISED CODE Section 102.01 As used in Chapter 102. of the Revised Code: (A) "Compensation" means money, thing of value, or financial benefit. "Compensation" does not include reimbursement for actual and necessary expenses incurred in the performance of official duties.
(B) "Public official or employee" means any person who is elected or appointed to an office or is an employee of any public agency. "Public official or employee" does not include a person elected or appointed to the office of precinct, ward, or district committee member under section 3517.03 of the Revised Code, any presidential elector, or any delegate to a national convention. "Public official or employee" does not include a person who is a teacher, instructor, professor, or any other kind of educator whose position does not involve the performance of, or authority to perform, administrative or supervisory functions.
(C) "Public agency" means the general assembly, all courts, any department, division, institution, board, commission, authority, bureau or other instrumentality of the state, a county, city, village, township, and the five state retirement systems, or any other governmental entity. "Public agency" does not include a department, division, institution, board, commission, authority, or other instrumentality of the state or a county, municipal corporation, township, or other governmental entity that functions exclusively for cultural, educational, historical, humanitarian, advisory, or research purposes; does not expend more than ten thousand dollars per calendar year, excluding salaries and wages of employees; and whose members are uncompensated.

I. Bills / Pending Legislation The current status of any Ohio bill can be ascertained from the following online systems: Hannah Information System (Legislation file), Lexis (OHIO library, OHTRCK file) and Westlaw (OH-BILLTRK database). You can also call the Ohio Legislative Hotline (1-800- 282-0253) You will find the full text of pending bills on Hannah, Lexis (OHIO library, OHTEXT file) and Westlaw (OH-BILLTXT database). Bills that have already become laws are available on Hannah or in the Laws of Ohio KFO25 .A3, Baldwin's Ohio Legislative Service KFO15 .B34, or the Current Service binder of Page's Ohio Revised Code KFO30 1953 .P3. There is a problem with the latter three sources in that you might wait a few years before the law shows up in Laws of Ohio, or a few months in the case of Ohio Legislative Service or Page's Ohio Revised Code. If you are looking for quick synopses of bills that have passed check the Ohio Legislative Service Commission's Summary of Enactments KFO15 .L43. Just a few words about the legislative history of Ohio laws. Debates, Hearings and Committee Reports are not officially recorded, although Hannah reports committee actions unofficially through its online system. House and Senate Journals are available, but they contain only procedural accounts of the legislative activity of each chamber. Your best bet is to look at the history of your revised code section and read the bills that have amended it. The Legislative Service Commission's bill analyses are also a useful tool. While not providing legislative intent, they are useful summaries of the bill and any amended versions. Baldwin's prints selected ones in Ohio Legislative Service, while Hannah has all of the analyses from the 117th General Assembly forward.

Held , in view of the foregoing, the claimant is precluded from becoming entitled to child's insurance benefits on his father's earnings record.
Section 404.305(b) of Regulations No. 4 provides, in pertinent part, that
"(b) Insured's death caused by an intentional act. You may not become entitled to or continue to receive any survivor's benefits or payments on the earnings record of any person if you were convicted of a felony or an act in the nature of a felony of intentionally causing that person's death. . . ."
For certain homicides, e.g., first or second degree murder, the Social Security Administration (SSA) presumes intent, because by definition, these crimes involve intent. However, voluntary manslaughter may or may not be defined as involving intent; therefore, SSA establishes no presumption of intent. Instead, SSA bases its decision as to entitlement or nonentitlement on whether the State where the conviction occurred treats voluntary manslaughter as an intentional homicide. If State law is inconclusive, development of the facts related to intent is required. In Ohio, voluntary manslaughter is a felonious homicide. However, a person can be convicted of voluntary manslaughter if he or she "knowingly" caused the death of another regardless of whether he or she "intended" to cause that death.

Nonconforming New Motor Vehicles 1345.71 Definitions. As used in sections 1345.71 to 1345.77 of the Revised Code: (A) "Consumer" means the purchaser, other than for purposes of resale, of a motor vehicle, any person to whom the motor vehicle is transferred during the duration of the express warranty that is applicable to the motor vehicle, and any other person who is entitled by the terms of the warranty to enforce the warranty. (B) "Manufacturer" and "distributor" have the same meanings as in section 4517.01 of the Revised Code, and manufacturer includes a re-manufacturer as defined in that section. (C) "Express warranty" and "warranty" mean the written warranty of the manufacturer or distributor of a new motor vehicle concerning the condition and fitness for use of the vehicle, including any terms or conditions precedent to the enforcement of obligations under that warranty. (D) "Motor vehicle" means any passenger car or noncommercial motor vehicle as defined in section 4501.01 of the Revised Code, or those parts of any motor home, as defined in section 4501.01 of the Revised Code, that are not part of the permanently installed facilities for cold storage, cooking and consuming of food, and for sleeping, but does not mean any mobile home as defined in division (O) of section 4501.01 of the Revised Code, recreational vehicle as defined in division (Q) of that section, or manufactured home as defined in division (C)(4) of section 3781.06 of the Revised Code.

THIS A GENERAL FACT SHEET ON THREE PIECES OF LEGISLATION CURRENTLY PENDING BEFORE THE GENERAL ASSEMBLY. The three bills are: SB120 SB106 and SB108. The league supports all three pieces of legislation General Facts Ohio is in good company by trying to address lawsuit abuse this year. At least two-thirds of state legislatures are expected to introduce bills related to civil justice reform during the 2001 legislative sessions, according to the American Tort Reform Association (ATRA). Lawsuit abuse negatively impacts the citizens of Ohio and threatens the state s economic competitiveness. Several different studies put the cost of lawsuit abuse for every Ohioan at somewhere between $1,200 and $1,500 per person, per year . (ATRA) Past studies have shown that the system is out of control, with a civil liability suit in Ohio filed once every 17 minutes . The problems of out of control personal injury trial lawyers seeking unreasonable multimillion-dollar awards are pervasive in our civil justice system. (ATRA) Ohioans deserve a fair system that appropriately compensates victims, not lawyers. In 2000 alone, 12 states enacted some forms of tort reform. (ATRA)
