Section 89. (a) A commonwealth charter school shall be a public school, operated under a charter granted by the board of education, which operates independently of any school committee and is managed by a board of trustees. The board of trustees of a commonwealth charter school, upon receiving a charter from the board of education, shall be deemed to be public agents authorized by the commonwealth to supervise and control the charter school. (b) A Horace Mann charter school shall be a public school or part of a public school operated under a charter approved by the local school committee in which the school is located and by the local collective bargaining agent; provided, however, that all charters shall be granted by the board of education. Horace Mann charter schools shall be operated and managed by a board of trustees independent of the school committees which approve said schools. The board of trustees may include a member of the school committee.

EXECUTIVE SUMMARY
November 1999
INTRODUCTION Legislation authorizing the establishment of public charter schools in Massachusetts was enacted in 1993 as Massachusetts General Laws Chapter 71, Section 89 and subsequently amended in 1995, 1996, 1997, and 1998. Chapter 46 of the Acts of 1997, which amended the charter school law, directed the Office of the Inspector General to conduct a study of operations, practices, and activities at the established charter schools in the Commonwealth. In conducting this review, the Office reviewed records obtained from the Department of Education (DOE) as well as from the 24 charter schools in the scope of this review. The Office also conducted interviews with officials of the DOE's charter school office. The Office appreciates the DOE's assistance and cooperation during the course of this review. This report focuses on the business operations of the 24 charter schools in this review. The report findings highlight weaknesses that could undermine charter schools' ability to achieve their educational objectives and jeopardize the interests of state taxpayers, whose dollars fund charter schools. The report recommendations are aimed at strengthening the Massachusetts charter school initiative, increasing charter school accountability, and protecting the public's investment in charter schools. Background on Charter Schools Charter schools represent one facet of a national reform movement that has promoted and engendered innovative public education approaches and organizational arrangements in many states, including Massachusetts. Charter schools are generally free to establish their own curricula, hire their own staff, and control their own finances. In return, charter schools are expected and obligated to fulfill the objectives of their charters. An underlying premise of the charter school concept is that introducing competition into the public education system will have beneficial effects.

Study Shows Link Between School Breakfast and Academic Achievement School breakfast makes a difference for learning. Drs. Michael Murphy and Ronald Kleinman, researchers from Massachusetts General Hospital (MGH), in collaboration with Project Bread and Boston Public Schools, have found that increasing school breakfast participation is associated with a reduction in child hunger and with improved nutrition, school attendance, emotional functioning, and math grades. These findings, released in November 2000, are from a two-year evaluation of the universal free breakfast pilot program (all students are eligible for free breakfast regardless of family income) in 16 Boston schools. Hunger and Nutritional Status of Students Before the Pilot Program. Based on interviews with students and their parents, researchers found that prior to the start of the pilot program about one quarter of the students in these Boston public schools were classified as hungry or at risk for hunger and about one third of all students were classified as having a low intake of one or more critically important nutrients in their diets. Similar to the results from prior research conducted by the research team in Philadelphia, hungry students and students at nutritional risk were found to have poorer grades and more symptoms of emotional/ behavioral problems.

General Legislative Provisions
This first part of the review examines statutory provisions that have implications for, but do not necessarily address directly, students with disabilities or special education. Various provisions in state statutes grant charter schools varying levels of authority to govern themselves and to make decisions regarding the operation of the schools, including decisions related to personnel, curriculum, and expenditures. The extent of a charter school's operational autonomy will have an impact on how special education programs are implemented in these schools. As described in the following paragraphs, statutory provisions that give higher levels of autonomy include ones that allow or require charter schools to (1) operate independent from local school districts, (2) make their own personnel decisions, (3) be exempt from state and district education laws and regulations, (4) assume liability for their actions, and (5) receive their funding directly from the state. Japanese language and culture studies are offered at secondary and other schools in all six of the New England states. Among them, in alphabetical order by state are:
Connecticut
Among the private schools in Connecticut to include Japanese in their curriculum are the Taft School in Watertown and the Kent School in Kent. Both are four-year high schools that offer four years of Japanese language instruction. Taft also has as an independent project for those students who have completed this course of study and a one-semester elective course in Japanese history, mainly for seniors.
Maine
K ennebunk High School offers an elective first-year Japanese language course, which meets once a day.
Massachusetts
A few public high schools in Massachusetts offer Japanese. Among them are the Boston Latin Academy with three years and the Muriel Snowden International School , also in Boston, with four years. As for private high schools, Thayer Academy in Braintree is an independent day school that has an agreement with the Hokkaido Board of Education. Every 18 months, Hokkaido sends a teacher of English from one of their schools; Thayer supplies this individual with room and board in return for teaching Japanese language and a survey of Japanese culture.
New Hampshire
Exeter Area High School, a public school in Exeter offers beginning, intermediate, and advanced Japanese language as well as an Asian social studies course. In addition to speaking skills, the first year language program covers hiragana and katakana; at the intermediate level, students learn about 200 kanji; in the advanced class, another 200 are covered. The school also has an extracurricular Japanese club that meets for monthly cultural activities and a Japanese animation club that meets weekly. Exeter's Japanese language instructor, Yuki Minami, sponsors a chapter of the Japanese National Honors Society at the school.
