Libya, Politics, 3/2/2000 Libya appointed Mubarak al-Shamekh as its new prime minister after eliminating the majority of the government ministries, Gulf Times reported, adding that Beshir Bujeneh and Bagdadi Mahmudi were named as deputy prime ministers for production and services, respectively, while Abdel Rahman Shalgham was named foreign minister. Libya's political system is theoretically based on the political philosophy in Qadhafi's Green Book, which combines socialist and Islamic theories and rejects parliamentary democracy and political parties. In reality, Qadhafi exercises near total control over the government. The Libyan court system consists of four levels: summary courts, which try petty offenses, the courts of first instance, which try more serious crimes; the courts of appeals, and the Supreme Court, which is the final appellate level. The GPC appoints justices to the Supreme Court. Special "revolutionary courts" and military courts operate outside the court system to try political offenses and crimes against the state. Libya's justice system is nominally based on Sharia law. POLITICAL CONDITIONS After the revolution, Qadhafi took increasing control of the government, but he also attempted to achieve greater popular participation in local government. In 1973, he announced the start of a "cultural revolution" in schools, businesses, industries, and public institutions to oversee administration of those organizations in the public interest. The March 1977 establishment of "people's power"with mandatory popular participation in the selection of representatives to the GPCwas the culmination of this process. The GPC is the legislative forum that interacts with the General People's Committee, whose members are secretaries of Libyan ministries. It serves as the intermediary between the masses and the leadership and is composed of the secretariats of some 600 local "basic popular congresses."

It is time to begin rebuilding the UN Commission on Human Rights into a body that fulfills its original mandate to champion democracy, freedom, and the human rights of all people, bringing scrutiny to bear on the worst offenders. The United States will continue to make its position clear. We seek to actively engage and strengthen the moral authority of the Commission on Human Rights, so that it once again proves itself a forceful advocate for those in need of having their human rights protected. We are convinced that the best way for the Commission to ensure the ideals of the Universal Declaration of Human Rights over the long-term is to have a membership comprised of countries with strong human rights records at home. Today, America celebrates the birthday of Dr. Martin Luther King Jr, a champion of freedom and human dignity. We regret that more members of the Commission did not join with us on this day in sending a clear message to Libya and the rest of the world that human rights violators are not fit to occupy positions of moral or political authority in the United Nations system.

At various times in its history the territory that is now Libya was occupied by Carthage, Rome, Arabia, Morocco, Egypt, and Spain. It was part of the Ottoman Empire from 1551 to 1911, serving in the 18th cent. as a base for pirates who, in return for immunity, provided large revenues to the local ruler. Libya was seized by Italy in 1911, but Libyan resistance continued until the 1930s. During World War II, as an Italian colony, it was one of the main battlegrounds of N Africa (see North Africa, campaigns in), passing under an Anglo-French military government when the Axis was defeated in the area in 1943. In accordance with a UN decision, in 1951 the country became independent as the United Kingdom of Libya, with King Idris I as ruler.
Idris was ousted in 1969 in a coup d'etat led by Col. Muammar al-Qaddafi, who established an anti-Western dictatorship. British and American bases were closed in 1970, and unification was sought, unsuccessfully, with several other Arab countries. An implacable foe of Israel, Qaddafi used Libya's vast oil wealth to create an extensive social welfare system and to help support the Palestinian guerrilla movement, particularly radical elements. In 1979 Libya intervened in Uganda to help keep Idi Amin in power, and in 1981 it dispatched troops into neighboring Chad (Libya had occupied the disputed Aozou Strip, in N Chad, in 1973), withdrawing most of them later that year. Qaddafi's forces continued to take sides in Chadian fighting, eventually occupying much of N Chad, but they were pushed back somewhat in 1987. In 1990 the dispute over the Aozou Strip was submitted to the International Court of Justice.

History
The Romans invaded Tripolitania (the region around Tripoli) in 106 BC, and by 64 BC, Julius Caesar's legions had completed the occupation. As a Roman province, Libya was prosperous, reaching a golden age in the 2nd century AD. The three principal Roman cities of Sabratha, Oea and Leptis Magna provided the empire with grain, oil and a supply of slaves and exotic goods from sub-Saharan Africa. The decline of the Roman Empire saw the classical cities fall into ruin, a process hastened by the Vandals' destructive sweep though northern Africa in the 5th century AD. When the Byzantines took over in the 6th century, efforts were made to strengthen the old cities, but it was only a last gasp before they collapsed into disuse. Only Oea, which survives today as Tripoli, the nation's capital, remains a living city. The Arab invasion of the 7th century brought Islam to the country, where it remains firmly entrenched to this day. Arab rule was culturally fruitful, and many examples of early Islamic architecture remain, especially in the oases of the south. The Arabs ruled Libya until the Turks conquered the country in the mid-16th century, administrating it through a succession of locally appointed rulers who levied a toll on every Christian fleet using the Mediterranean. Following the Napoleonic wars, European powers began to colonise northern Africa, and the Turks hastened to strengthen their control of Libya. Their last North African possession, Libya was taken from the Turks by Italy in that country's last-minute bid for colonies in Africa. The ensuing colonial period proved devastating for native Libyans, as the large-scale 'Italianisation' of the country saw half of the indigenous population either exiled or exterminated between 1911 and the end of WWII. The crowning insult was being reduced to a theatre of war in which huge minefields were laid, some of which remain.

Libya to invest into Soviet-design Cuban oil-refinery
The Libyan government is considering an investment project into a Cuban oil refinery, which was built in the Cienfuegos province using Soviet technologies.
Ali Rodriguez, the President of the Petroles de Venezuela State Company, disclosed this information when speaking to journalists in Caracas.
The refinery with a 3-million ton output in Cienfuegos was completed in 1991, but the production was never started there. According to Rodriguez, a Libyan governmental delegation has visited the company's headquarters this week. In line with a relevant request, the company submitted to the Libyan side all necessary information concerning investments into the facility.
Some three years ago, Petroles de Venezuela carried out a special research programme related to investments necessary to modernise the refinery.
Experts believe that the Cuban oil refinery needs at least 200 mln. dollars to start operating.

Executive and Legislature
The head of state is the secretary of the General People’s Congress. This body, effectively the parliament, is indirectly elected through a structure of local “basic people’s congresses”. The General People’s Committee, broadly equivalent to a Council of Ministers, has a secretary general who operates as a prime minister.
Justice
The system of law is based on Italian and Islamic law, with civil, commercial and criminal codes substantially following Egyptian models. There are civil and penal (assize and appeal) courts. Separate religious courts deal with matters of personal status of family or succession matters affecting Muslims according to the Islamic law. The death penalty is in force.
