SCHOOL OF NURSING OFFERS LEGAL ISSUES COURSE
LUBBOCK – Texas Tech University Health Sciences Center’s continuing nursing education program will present “Nursing: Legal Issues in Every Realm” Feb. 14 at the Packard Lab on the Texas Tech campus in Junction. The purpose of the program is to provide a general legal framework for nurses practicing in today’s health care environment. Specific emphasis will be on malpractice liability, documentation and risk management. Case examples and the role of the defendant nurse will be included. Registration for the course will take place from 8:30 a.m. to 9 a.m. The course is scheduled from 9 a.m. to 3 p.m. and lunch will be served on campus. The registration fee for the course is $69 if paid before Jan. 31 and $84 after the deadline. Speakers for the course are Kip Poe, R.N., M.S.N., J.D., and Ken Braxton Jr., J.D. Poe is a former attorney for the Texas Tech University Office of General Counsel Professional Liability Division. She has 15 years of experience as a medical malpractice and health law attorney and is currently employed at Morgan and Weisbrod . Braxton is currently employed at Morgan and Weisbrod . He has spent the last 14 years defending medical negligence cases on behalf of more than 900 physicians at the Texas Tech School of Medicine. Participants will receive 5.3 contact hours upon completion of the course.

Gary Sherman In the past four years, online legal and non-legal information has erupted on the many databases which make up the Internet Information from around the world is now readily available at our fingertips. With enhanced access to worldwide networks of data bases, citation problems have also emerged. What format should we use to cite online cases and other materials? Various legal and other professional organizations have been addressing these questions for several years. Most of the proposed formats are still in the draft stages. This is probably because the online electronic database networks are changing daily, and new questions arise almost as quickly. While the various organizations continue to refine recommendations for citation systems that will not totally disrupt the way we do business today, we need some kind of guidelines to cite the sources that many of us are already using. This paper provides interim guidelines for citation of legal and non-legal sources. It is a combination of suggestions from legal and non-legal professional writing groups, applied to the legal context. The guidelines are basic and general in nature, and can be applied to the Michigan Citation System, the BLUEBOOK format, or others used by attorneys. But first, a bit of history to understand the context in which these guidelines are proposed.

    The Government is committed to strengthening the public health system, achieving the best health and disability support outcomes for New Zealanders and reducing disparities between population groups. The New Zealand Public Health and Disability Act 2000 (NZPHD Act) facilitates the achievement of the Government's aims by:
    • requiring the development of the New Zealand Health Strategy and the New Zealand Disability Strategy and requiring an annual report to Parliament on the progress in implementing these strategies
    • encouraging co-operation and collaboration between the agencies in the sector with the aim of delivering better health care
    • strengthening local community input to decision making about health and disability services.

    The NZPHD Act is concerned with entities and arrangements across the health and disability sector. It focuses predominately, however, on the creation of 21 District Health Boards to fund or provide services for geographically defined populations and be responsible for public hospitals and other related services. DHBs will play a significant part in achieving the Government's goals set out in the New Zealand Health Strategy.
    DHBs are Crown Entities responsible to the Minister of Health for their performance. The Minister of Health, in turn, is responsible to Parliament for the overall performance of the health and disability sector.

Professor calls on the legal system to monitor health care
Yet in recent years, physicians and attorneys have been adversaries, facing off in court and in public debate about such things as malpractice lawsuits. A University of Michigan researcher says that, to the detriment of patients, these two professions have focused on their differences and have ignored what they share in common. Peter Jacobson, a U-M health policy researcher, advocates greater cooperation between the medical and legal systems. In his new book, "Strangers in the Night: Law and Medicine in the Managed Care Era," Jacobson calls on attorneys, physicians and managed care executives to work together to restore Americans’ trust in their health care system. Because the managed care system puts the decisions about both providing and paying for health care in the same hands, many Americans question the fairness of the system and worry that their needs are shortchanged to lower health care costs. They sometimes turn to legal remedies for help. Jacobson believes the judicial system can inject clarity into sometimes-vague health care policies and regulations. Jacobson
Under the fiduciary care framework, Jacobson would expect managed care plans to set up impartial and understandable systems to decide whether to pay for treatment that a physician recommends. Judicial oversight would resolve conflicts between patients, physicians and health insurers, helping to inject fairness and clarity into decisions to delay or deny health care.

YCHS is an interdisciplinary research unit within the university. Work at the Centre proceeds from the assumption that the health of populations is affected by a number of factors in addition to biomedical ones, and that these variables - - social, political, economic, cultural and historical - - must be taken into account in work on individual and community health. Contributors Rona Achilles , Ph.D. is an adjunct Assistant Professor, Department of Public Health Sciences, Faculty of Medicine, University of Toronto, and a Toronto-based independent consultant. She is also an (independent) core partner with the Centre of Excellence for Women's Health at York University (National Network on Environments in Women's Health). Previously, she was the Coordinator of Sexual Health Research for the Department of Public Health, City of Toronto. She also worked as a consultant for the Royal Commission on New Reproductive Technologies, and has published extensively on the psycho-social issues involved in new reproductive technologies. Her research interests are Aboriginal health, women's health and alternative medicine.
