Legal ResearchStarting
Let’s assume that you are particularly interested in the question of the legal protection of computer programs. How do you begin? If you are lucky someone else has already had that same question and has at least begun the research for you. As the first rule of research is "Don’t repeat work that someone else has already done," try to locate a good book or article already on this subject that you can use as a springboard for you research. Three good places to look for a good article are:
1. Legal Trac on HOLLIS [Also available on Westlaw (LRI) and on Lexis (LAWREV;LGLIND)] for articles from mainly Anglo-American journals.
2. European Legal Journals Index [ILS RR KJC 37.E97 in paper and electronically on CD-ROM in the ILS RR and on Westlaw (LJI-INDX)] is an excellent index for EU information as it covers a large number of English language journals not indexed in Legal Trac which have a particular emphasis on EU law, particularly from the European perspective.
3. SCAD, a multilingual database with abstracts in the language of the original work, is one of the best sources for citations to periodical articles on the EU. It indexes the Official Journal, both L and C parts, approximately 15,000 journals received at the Commission and the Court libraries along with other official publications of the Community. The latest attempt by Martha Blue to crack the writing field fails dismally. This wildly uneven work attempts to guide the small- to medium size publisher through the legal landscape from authorship to manufacture to distribution. Blue, in her introductory caveat states that, This legal guide assists publishing concerns engaged in producing and distributing the printed word. Neither I nor the publisher make any expressed [sic] or implied warranty with regard to the forms' use or freedom from error. Each form must be reviewed by a knowledgable [sic] lawyer so that his or her expertise may be applied to your specific legal problem. With the above warning in place, why should publishers and attorneys purchase this book? I propose two answers, one of which only addresses the aesthetic, not substantive element. First, By the Book The Publishing Law Handbook Entertainment Industry Contracts By the Book is beautifully designed (save for the absence of running headers informing the reader of his place in the book) with readable typeface, leather binding and marbleized cover and paper designed by Peggy Skycraft. It begins as a deliberate decentering of a dominant tradition in order to discover what may be missing as a result of the traditional double reduction of vision as the main variable and metaphor. he growing popularity of aural metaphors in contemporary American legal discourse has already drawn some comment from observers, but so far it has attracted only the most superficial of explanations.

In the midst of a culture saturated with printed and electronic texts and bombarded by images from television and movies, it cannot be denied that seeing remains at the center of American sensory experience. There is nonetheless evidence to suggest that in the late twentieth century we are increasingly fascinated with - and in a few instances, are even becoming biased towards - aural expression and experience.

History, What Is It Good For? A Commentary on a Talk by Richard Posner Written by Ryan Fortson Hegel remarks somewhere that all facts and personages of great importance in world history occur, as it were, twice. He forgot to add: the first time as tragedy, the second time as farce. . . . Men make their own history but they do not make it just as they please; they do not make it under circumstances chosen by themselves, but under circumstances directly encountered, given and transmitted from the past. What does it mean to make a farce of history? A farce occurs when a commonly accepted story or situation is twisted in such a way as to make it appear ridiculous. To suggest that history can be mocked, then, requires that there be some way of distinguishing between valid and invalid interpretations of history. In attempting to make this distinction, however, one runs into the problem that all interpretations necessarily contain a large subjective element to them, thus calling any supposed validity they may have into question. In law, this problem is compounded by the fact that when addressing legal precedence, one interprets cases, which are themselves interpretations of events. In other words, the judge is forced to provide an interpretation of an interpretation. In a cultural milieu in which even scientific inquiry is thought by some to be historically contingent and socially conditioned

The materials document the cultural history of the Andean people before the Spanish conquest; colonial civil administration; the role of the Catholic church in colonial society; the Bourbon reforms, the war of independence; the anarchy of the early republican period and the war of the Confederation Peru-Bolivia. A Lawyer's Reading List:
John H. Wigmore, in 1941, was represented as being a lecturer of comparative law in Northwestern University. He was the author of a number books, including; Panorama of the World's Legal Systems Science of Judicial Proof and A Kaleidescope of Justice Containing Authentic Accounts of Trial Scenes from all Times and Climes . In 1922, this very learned scholar, Wigmore, submitted an essay to the Illinois Law Review entitled, "A List of one Hundred Legal Novels" (# 17, p. 26). Wigmore prepared this list with lawyers in mind, his thinking being that lawyers could learn much from the great novel writers of the past. Wigmore broke his list down into four categories: (A) Novels in which some trial scene is described - perhaps including a skilful cross-examination;
(B) Novels in which the typical traits of a lawyer or judge, or the ways of professional life, are portrayed;
(C) Novels in which the methods of law in the prosecution and punishment of crime are delineated; and
(D) Novels in which some point of law, affecting the rights or the conduct of the personages, enters into the plot.

Last April, a brief series of events occurred in a Madison, Wisconsin, restaurant that spoke volumes about the current character of the homosexual rights movement. An employee of the Espresso Royal Cafe asked two women - presumably lesbians - to refrain from passionately kissing as they sat at a window table. Madison's gay community was not amused. The very next day, about 125 homosexual demonstrators showed up on the premises, and conducted a "kiss-in" for several minutes. A spokeswoman for the protesters, Malvene Collins, demanded, "You say gays and lesbians cannot show affection here? Why not here but in every other restaurant in Madison?" The establishment's chastised owner, Donald Hanigan, assured the crowd, "I regret that this incident ever happened. I want all of you to come in here every day." In October, several dozen homosexual males, many of them dressed in women's clothing, openly hugged and kissed in a terminal of Seattle-Tacoma Airport, and handed out condoms and leaflets to travelers. Matt Nagel, spokesman for the Seattle chapter of a new homosexual organization, Queer Nation, seemed to sum up the feeling among militants in the local homosexual community. "We're going to homophobic bars, we're going to pack them, we're going to be openly affectionate, we're going to dance together and make it uncomfortable for all the straight people there."

25.1 The Rare Books Department purchases books and pamphlets in European languages printed before 1850. (For the purchase of second- hand material after 1850 see section 24.1 .) This range covers periodical publications, often in collected editions, but including, for example, individual early newsbooks and runs of periodical issues. Some purchases contain music (playtexts, opera librettos) and maps (topographical and travel books) but the chief responsibility for antiquarian music rests with the Music Department (see section 14.3.5 ) and for maps and atlases with the Map Room (see section 15.4 ). While all European languages, ancient and modern, are within the remit of the Rare Books Department, the main modern languages predominate. 25.2 The general principle for book selection is that of building on the existing strengths of the Library's collections, thus increasing their already rich research potential. Purchases are concentrated on works of substantial interest not trivia. The range of these collections is very wide but the following categories are of special importance: 1) incunables and post-incunables, i.e. books printed up to 1520. (These tend to be expensive, and hence occasional, purchases.)
