Information on the library 1. Status and organisation The Library was established in 1953 when the Court was created. It is part of the Library, Research and Documentation Directorate. The rules governing the functioning of the Library are contained in the Internal Rules of the Court of 19 February 1975, Chapter V, amended on 18 June 1980. 2. General Description 2.1. Location The Library comprises a reading room situated on level -1 of the C building and a storage room on level -3 of the same building. Access to the storage rooms is restricted . The Library also has a branch in the T building for use by the various divisions of the Translation Directorate.
The help-desk is situated on level -1 of the C building at the entrance to the reading room. 2.2. The Library's collection

    About the Chief Counsel Jay Alan Sekulow is Chief Counsel for the European Center for Law and Justice (ECLJ), an international public interest law firm and educational organization. An accomplished and respected judicial advocate, Mr. Sekulow has appeared before the United States Supreme Court nine times in defense of religious freedom and acts as the Chief Counsel for ECLJ affiliates, The American Center for Law and Justice and The Slavic Center for Law and Justice. Two of the landmark cases argued by Mr. Sekulow before the Supreme Court in the United States have become part of the legal landscape in recent years in the area of religious liberty litigation. In the Mergens case, Mr. Sekulow cleared the way for public school students to form Bible clubs and religious organizations on their school campuses. In the Lambs Chapel case, Mr. Sekulow defended the free speech rights of religious groups ensuring that they be treated equally with respect to the use of public facilities.

    * Professor at the Faculty of Law and Political Science, University of Nantes. T he "Great Transformation" (Polanyi, 1944) that gave birth to industrial society initially centred on free trade. The transformation of work came only later. The unforeseen consequences of the liberalization of trade and industry made it necessary to rethink the issue of work and turn nation states into Welfare States. But the Welfare State is now falling apart. Under the combined effects of technological and political change, international trade is growing while national institutions are undermined. Foremost among these is national labour law, which is suspected of impairing economic efficiency, as were trade guilds in the past. It may be a sign of the times that the new World Trade Organization has moved into the former building of the International Labour Organization on the verdant shores of Lake Geneva. L International Labour Review should be seen within that context.

    UNIDROIT Principles and Harmonization of International Commercial Law: Focus on Chapter Seven*

    INTRODUCTION Chapter 7 of the UNIDROIT Principles of International Commercial Contracts is significant on at least two levels. In practical terms, it is the substantive heart of the whole Principles. It is where the Principles’ solutions to a large proportion of real world disputes in commercial transactions are to be found. It is here that the remedial consequences of serious failures of performance are defined: orders of performance, damages, contract termination by rescission, and restitution. These are difficult and central substantive issues. Indeed, Chapter 7 is probably the most imaginative synthesis to emerge in this generation of some of the most difficult practical questions of contract law. It will be a powerful support for the harmonization of actual outcomes and improve the reliability of the often unpredictable results of disputes. The substantive content of Chapter 7 is important as an illustration of the creative power of the UNIDROIT Principles. Chapter 7 is also important as an example of how the Principles work and of their usefulness in the emerging pattern of harmonized international commercial law. Chapter 7 brings closer together the substantive outcomes in courts, arbitral tribunals, and institutions of alternative dispute resolution in different legal systems, thus providing a prime example of how harmonization of international commercial law can improve the law. I have pointed out elsewhere that harmonization is not always the equivalent of substantive reform that improves the operation of the law.
